T-Mobile Season Prize Pass Sweepstakes (“Sweepstakes”)

NO PURCHASE NECESSARY TO ENTER OR WIN. PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING.
ELIGIBILITY: Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia. Entrants must be 13 years of age or older at the time of entry. An eligible minor must have his/her parent’s or legal guardian’s permission to enter. Employees, officers and directors of T-Mobile USA, Inc. ("Sponsor"), Wasserman Media Group, Marketing Resources, Inc., The Garrigan Lyman Group, Publicis, Optimedia, Hornall Anderson Design Works and the National Basketball Association (“NBA”), its member teams, NBA Properties Inc., NBA Media Ventures, LLC, Inc. and their affiliates (collectively the “NBA Entities”), contractors and any others engaged in the sale of T-Mobile services/products or development, production or distribution of promotion materials, and their respective parents, affiliates, subsidiaries, advertising and promotion agencies (collectively, "Sweepstakes Entities"), including each of their respective immediate families (spouse, and parents, children, and siblings, and each of their respective spouses, regardless of residence) and persons living in the same household (regardless of whether related) as any of these individuals are not eligible to participate in the Sweepstakes. By entering the Sweepstakes, participants (and, if eligible minors, their parents or legal guardians) agree to release, discharge and hold harmless Sweepstakes Entities, their respective parents, affiliates, subsidiaries, retailers, agencies and all of their respective officers, directors, employees and agents (collectively, “Released Parties”), from any and all liability, claims, judgments, losses, injuries, demands, damages, actions, and/or causes of actions, whether direct or indirect, which may be due to or arise out of participation in the Sweepstakes or any portion thereof, or the acceptance, use/misuse or possession of prizes. These Official Rules and the decisions of the independent judges (Marketing Resources, Inc.), (“Judges”), are final and binding in all respects. Void where prohibited by law, rule or regulation. Sweepstakes is subject to all applicable federal, state and local laws.
HOW TO ENTER: To enter the Sweepstakes log on to: www.T-MobilePrizePass.com. Once on the registration page, complete the online entry form with your true and correct information in all required fields and click on the “Submit” button to be registered for the Sweepstakes and to receive one (1) Sweepstakes entry. Returning Entrants: You are only required to complete the online registration form the first time you register for the Sweepstakes. Returning entrants can log in by clicking on the “Already Registered? Login Here” link on the registration page. On the login page, you must provide your email address and password to login, click on the “Click and Enter Today” button to be submitted into the Sweepstakes for the day you are participating.
Each time you enter, you will receive one (1) entry into the current monthly drawing (“Monthly Drawing”). The first time you enter each month, you will also receive one (1) entry into the Grand Prize Drawing for the Sweepstakes. Limit one (1) Monthly Period entry per person per email address per day and one (1) Grand Prize Drawing entry per person per email address per month via this entry method, regardless of number of Monthly Drawing entries received during any Monthly Period (as outlined below). Entries received from any person or email address in excess of the stated daily and/or monthly limitation will be void. Any attempt by a person to use same, multiple/different email accounts to enter more times than is allowed by these Official Rules may result in disqualification, at the discretion of the Judges or Sponsor.
Entries will be deemed made by the authorized account holder of the email address submitted at time of entry and such individual must comply with these Official Rules. The “authorized account holder” of an email address is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be required to provide Sponsor with satisfactory proof that he/she is the authorized account holder of the email address associated with the potentially winning entry. In the case of an eligible minor, the winner’s parent or legal guardian may be the authorized account holder. Entries generated by script, macro or other automated means or any other means that subvert the entry process will be void. Entries that are incomplete, illegible or corrupted are void and will not be accepted. Information collected from the entrant is used only for the purpose of the prize drawing and to notify potential winners, and will not be re-used, sold or shared in any manner by Sweepstakes Entities or any third parties unless the entrant has elected to receive additional information and promotional material from Sponsor or a third party. Once the Sweepstakes has ended, all information supplied by entrants will be removed from the database. By entering the Sweepstakes, the entrant (and, if an eligible minor, his/her parent or legal guardian) agrees to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at http://www.t-mobile.com/info/legal/privacy.asp.
GRAND PRIZE DRAWING: At the conclusion of the Sweepstakes, a Grand Prize Drawing will be held by the Judges to select one (1) potential grand prize (“Grand Prize”) winner among all eligible entries received for the entire Sweepstakes. Odds of winning the Grand Prize depend on the number of eligible Grand Prize Drawing entries received throughout the Promotion Period. Grand Prize Drawing will be conducted on or about 5/4/09 by the Judges, whose decisions shall be final and binding on all matters relating to the Sweepstakes.
Grand Prize: A trip for Grand Prize winner and one (1) guest (“Guest”) to one (1) game during The Finals 2009 (“Trip”) (exact dates to be determined by Sponsor and the NBA Entities). Trip includes: Round-trip coach-class air transportation from a major U.S. gateway airport near winner’s home to The Finals 2009 (exact game/city to be determined by Sponsor and the NBA Entities); three (3) days/two (2) nights’ hotel accommodations for two (2) persons (one (1) standard room, double occupancy); an NBA Finals Memorabilia package (specifics and contents to be determined by the Sponsor); two (2) tickets to one (1) game of The Finals 2009; and a T-Mobile Device (to be determined by T-Mobile) and $100 in T-Mobile pre-paid services issued via gift card (gift card is subject to terms set by issuer) for the winner only. Approximate Retail Value (“ARV”): $5,000. The actual value of the prize may vary depending on point of departure and destination. Any difference between the stated ARV and actual value of the prize will not be awarded. Winner and Guest must be able to attend The Finals 2009 and travel on the designated travel dates designated by the Sponsor or the prize will be forfeited and Sponsor will have no further obligation to such winner. If Grand Prize winner is an eligible minor, his/her parent or legal guardian must accompany him/her on Trip as the Guest. Winner and Guest must travel together on the same itinerary and must travel to and from major airport near the winner’s residence selected by Sponsor on dates specified by Sponsor. Notwithstanding anything to the contrary stated herein, if the prize recipient’s residence is within 100 miles of the destination city, air transportation may be substituted for ground transportation and no substitution or compensation will be provided for difference in value. Air transportation may require connecting flights. Sponsor reserves the right to require the travelers to fly on certain days of the week, and/or at certain times of the day or night, and/or on certain airline carriers. Hotel rooms will be at Sponsor’s choice of hotel. Trip is subject to availability and confirmation of reservations. All costs or expenses not expressly included herein in connection with acceptance and use of the prize (including, without limitation, transportation to and from airport of origin and any additional transportation, food and beverages, luggage fees, and other incidental costs), and all federal, state, and local taxes, will be the sole responsibility of the winner. Winner’s Guest must be of legal age of majority in his/her state of residence (and at least 18 years of age), unless Guest is the child or legal ward of winner. Winner and Guest (or winner if Guest is an eligible minor) will be required to execute an Affidavit Release of Liability and Publicity prior to issuance of travel documents. Flight details are subject to space availability, and airline carrier’s regulations and conditions apply. The Trip may not be combined with any other offer, and travel may not qualify for frequent flyer miles. Any identification and travel document requirements associated with air travel are the winner and Guest’s sole responsibility. Sponsor is not responsible for lost or mutilated travel documents or tickets, and none will be replaced. Certain additional travel restrictions may apply. Airline tickets are non-refundable, non-transferable, and are not valid for upgrades. In the event that a particular sporting or other event (as described above) is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, or for any reason, Sponsor’s sole responsibility will be to award the remaining available portion of the prize, and no substitution or compensation will be provided for the unawarded portion of prize.
MONTHLY SWEEPSTAKES DRAWINGS AND PRIZES: There are a total of six (6) Monthly Drawings. For each Monthly Drawing, three (3) potential prize winners will be selected in an electronic randomized drawing among all eligible entries received on a timely basis (i.e., within the applicable time periods set forth below) for that Monthly Drawing by the Judges. Odds of winning a Monthly Drawing depend on the number of eligible entries received for the applicable drawing. Eligible non-selected entries will NOT be rolled into subsequent Monthly Drawings. Entrants must enter during each of the Monthly Periods in order to be entered for that Month’s Drawing. There is no monthly prize for the month of April. Limit one (1) Grand Prize entry per person for April. The schedule, eligibility dates, and prizes for each Monthly Drawing are as follows:

Monthly Drawing 1 – Three (3) Prizes: Two (2) tickets each to five (5) NBA Regular Season Games (for a total of 10 tickets), exact games and seat locations to be determined by Sponsor, and a $250 pre-paid gift card for winner only (gift card is subject to certain terms and conditions set by issuer). Winner is solely responsible for transportation to/from game. ARV: $2,750 each.
Monthly Drawing 2 – Three (3) Prizes: A video game chair and a video game bundle pack which includes five (5) video games of winner’s choice, subject to approval by Sponsor (games will be appropriate to the age of the winner, maximum ARV for each game is $75). ARV: $2,250 each.
Monthly Drawing 3 – Three (3) Prizes: A 47” Flat Screen TV and a Home Theatre System. Make and model to be determined by Sponsor. Installation is not included. ARV: $2,600 each.
Monthly Drawing 4 – Three (3) Prizes: A $2,000 shopping spree at an athletic apparel retailer (to be determined by Sponsor) awarded as a pre-paid gift card (gift card is subject to certain terms and conditions set by issuer). ARV: $2,000 each.
Monthly Drawing 5 – Three (3) Prizes: An NBA All-Star Prize Pack, including: All-Star gear (e.g. warm ups, jersey, head and wrist bands; exact items and sizes to be determined by Sponsor) and an All-Star commemorative basketball. Gear and basketball are not game used. ARV: $500 each.
Monthly Drawing 6 – Three (3) Prizes: A laptop computer and a laptop bag. Make and model to be determined by Sponsor. ARV: $1,200 each.
The total ARV of all prizes in the Sweepstakes is: $38,900.
NO PRIZE RECIPIENT HEREUNDER SHALL BE PERMITTED TO (A) REPLACE HIS/HER DESIGNATED PRIZE WITH ANOTHER PRIZE OR ITEM, (B) TRANSFER OR ASSIGN HIS/HER DESIGNATED PRIZE TO ANOTHER PERSON, OR (C) REDEEM HIS/HER PRIZE FOR CASH. SWEEPSTAKES ENTITIES RESERVE THE RIGHT, EXERCISABLE AT ANY TIME IN THEIR SOLE DISCRETION, TO SUBSTITUTE A PRIZE (OR PORTION THEREOF), PROVIDED THAT THE SUBSTITUTE PRIZE IS AN ITEM OF COMPARABLE OR GREATER VALUE. PRIZES ARE AWARDED “AS IS” WITH NO WARRANTY OR GUARANTEE, EITHER EXPRESS OR IMPLIED BY THE SWEEPSTAKES ENTITIES. ALL PRIZE DETAILS ARE AT SPONSOR’S SOLE DISCRETION. ANY COSTS AND EXPENSES ASSOCIATED WITH PRIZE ACCEPTANCE AND USE NOT SPECIFIED HEREIN AS BEING PROVIDED ARE WINNERS’ SOLE RESPONSIBILITY, INCLUDING ANY AND ALL FEDERAL, STATE AND LOCAL TAXES. EVENT TICKETS ARE SUBJECT TO TERMS AND CONDITIONS SPECIFIED THEREON. SEAT LOCATIONS WILL BE DETERMINED BY SPONSOR. WINNERS AND GUESTS MUST COMPLY WITH ALL VENUE RULES AND REGULATIONS. FAILURE TO DO SO MAY RESULT IN FORFEITURE OF TICKET PORTION OF PRIZE. GIFT CARDS AND PREPAID CARDS ARE SUBJECT TO TERMS AND CONDITIONS SPECIFIED THEREON.
PRIZE AWARDING: Limit of one (1) Monthly Drawing prize and one (1) Grand Prize per person, per email address, and per household. Prizes will only be awarded upon potential prize winner’s verification of eligibility and compliance with these Official Rules and final approval by Sponsor. If prize winner of any prize is an eligible minor, prize may be awarded to the parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. Potential winners of any prizes valued below $600 will receive prize notification via electronic mail, United States Postal Mail and/or overnight mail. All prizes will be fulfilled up to 6 to 8 weeks following completion of winner verification process. If a potential winner of any prize cannot be contacted; is ineligible; fails to claim the prize; if the prize or prize notification is returned undeliverable; or if the potential prize winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and, at Sponsor’s discretion, the prize may be awarded to an alternate winner in the drawing at issue. A potential winner of any prize valued above $600 will receive notification that he/she has been selected via electronic mail and/or phone and will have five (5) days from date notification was sent to reply to such notification, or, at Sponsor’s discretion, an alternate winner will be selected for the drawing at issue. After confirming notification receipt, the potential prize winner will be sent via United States Postal Mail and/or overnight mail, an Affidavit of Eligibility & Publicity/Liability Release forms, a W-9 form, and, if the potential winner of the Grand Prize, a Guest Release form to be completed by his/her Guest. These forms must be completed, signed, notarized and returned within five (5) days of date of issuance. The potential winner then, and only then, becomes the “actual” prize winner. If the potential recipient of any prize valued above $600 cannot be contacted; is ineligible; fails to return all forms completed and executed within the specified time period; fails to claim the prize; if the prize notification is returned undeliverable; if the potential prize recipient of the Grand Prize is unable to travel on the Sponsor designated travel dates, or if the potential prize recipient otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize, and the prize will be awarded, by means of another random drawing among all other eligible entries received for the drawing at issue. Each winner (and, if an eligible minor, his/her parent or legal guardian) grants the Sweepstakes Entities and their respective designees the right to use and publish his/her proper name and state of residence and to use his/her name, city and state of residence and likeness for advertising, promotional and other purposes, in any and all media now or hereafter devised, worldwide in perpetuity, without notice, permission or further compensation, except where prohibited by law. All information collected will be treated in a manner consistent with Sponsor’s privacy policy. All decisions of the Sponsor and Judges shall be binding and final.
DISQUALIFICATION: Released Parties are not responsible for late, lost, inaccurate, incomplete, misdirected, delayed, stolen or garbled registrations, entries or referrals or for technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware, software or web site. Released Parties are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information, howsoever caused, or other error of any kind, whether human, mechanical, electronic, network, human, typographical, printing or otherwise, relating to or in connection with this Sweepstakes, including, but not limited to, errors which may occur in connection with the administration of the Sweepstakes, the processing of registrations, entries or referrals, the announcement of the prizes or in any Sweepstakes-related materials. Entrants found tampering with or abusing any aspect of this Sweepstakes, as solely determined by the Judges, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in the Sweepstakes and void all associated entries. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right (among other causes of action and remedies) to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Sweepstakes (or any portion thereof) if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Sweepstakes (or any portion thereof), as determined by Sponsor in its sole discretion. In the event of termination or cancellation, Sponsor reserves the right to award the prizes for the drawing(s) at issue at random from among the non-suspect, eligible entries received for such drawing(s) up to the time of the impairment. Sponsor will award only the number of prizes stated in the Official Rules for any Promotion Period. In no event will more prizes be awarded than those listed in these Official Rules.
TAX INFORMATION: All applicable federal, state, local, and other taxes on prizes are the sole responsibility of the winners.
GENERAL INFORMATION: Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed exclusively by, and construed exclusively in accordance with, (a) the laws of the State of Washington (without giving effect to any choice of law or conflict of law rules (whether of the State of Washington, or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington) and (b) the federal laws of the United States of America.
